Please read these Terms carefully. Section 17 contains a binding arbitration agreement and class action waiver that affect how disputes are resolved.

1. Acceptance of These Terms

These Terms & Conditions (“Terms”) govern your use of riseaesthetics.co (the “Site”) and the services, bookings and communications offered through it by Rise Aesthetics, LLC (“Rise Aesthetics,” “we,” “us” or “our”). By using the Site, booking a consultation or submitting a form, you agree to these Terms, our Privacy Policy and our SMS Terms & Conditions. If you do not agree, please do not use the Site.

We may update these Terms at any time. Changes take effect when posted, and your continued use of the Site means you accept them.

2. Eligibility

You must be at least 18 years old to use the Site or book services. Treatments are performed by licensed providers at our clinic in Scottsdale, Arizona. Submitting a request does not obligate us to accept you as a patient, and we may decline to provide services at our discretion.

3. Not Medical Advice

Content on the Site, including blog posts, videos, embedded social media posts and before-and-after photos, is for general education only. It is not medical advice, a diagnosis or a treatment recommendation, and it does not replace an evaluation by a qualified provider.

Using the Site, reading our content or sending us a message does not create a provider-patient relationship. That relationship begins only after a consultation and our acceptance of you as a patient.

4. Medical Emergencies

The Site, our email and our text messages are not monitored for emergencies. If you think you are having a medical emergency, including a reaction after treatment, call 911 or go to the nearest emergency room. Existing patients with an urgent post-treatment concern should follow their aftercare instructions and call us at 623-252-5729.

5. Virtual Consultations and Treatment

Consultations at Rise Aesthetics take place virtually. A virtual consultation lets us review your goals, health history and photos and build a treatment plan, but it does not guarantee that you are a candidate for treatment. Your provider confirms your plan in person before any treatment and has the final say on whether a treatment is appropriate and safe for you.

You agree to give us complete and accurate health information, including medications, allergies, pregnancy or breastfeeding, medical conditions and prior aesthetic treatments. Virtual consultations are offered only where permitted by the laws that apply to your location at the time of the consultation.

6. Results Vary

Aesthetic results differ from person to person and depend on anatomy, skin, health, lifestyle and how closely you follow aftercare. Before-and-after photos and testimonials show individual experiences and are not a promise of your results. We do not guarantee any specific outcome, how long results will last, or that a treatment will be free of side effects. Your provider will review benefits, risks and alternatives with you, and you will sign a separate informed consent before treatment.

7. Booking, Cancellations and Payment

Pricing. Prices shown on the Site are estimates and may change. Your final cost depends on your treatment plan, including the number of units, syringes, vials or sessions you need.
Cancellations and no-shows. Please give at least 48 hours’ notice to cancel or reschedule. If you miss an appointment or cancel the same day, a card on file is required to book again. If you then miss or cancel the same day again, a $100 fee will be charged to that card.
Late arrivals. If you arrive more than 15 minutes late, we may need to shorten or reschedule your appointment.
Promotions. Offers cannot be combined unless stated, have no cash value, and may be changed or ended at any time.
Packages and prepaid treatments. Packages apply only to the treatments listed, are non-transferable, and expire 12 months after purchase unless the law requires otherwise. If your provider determines you are not a medical candidate for a prepaid treatment, the unused amount will be credited toward another treatment or a skincare purchase.
Gift cards. Gift cards are non-refundable and cannot be redeemed for cash, except where required by law.

8. Before-and-After Photos and Testimonials

Patient photos and testimonials on the Site are shared with the patient’s written consent. Photos are not altered to change results; edits are limited to cropping, lighting and privacy. Reviews reflect each patient’s own opinion.

9. Intellectual Property

Everything on the Site, including text, photos, videos, graphics and logos, belongs to Rise Aesthetics or is used with permission, and is protected by copyright and trademark law.

You may view Site content and share links to it for personal, non-commercial use. You may not copy, republish, sell or edit our content, or use our photos or videos in your own marketing, without our written permission. You may not scrape the Site or use its content to train artificial intelligence or machine learning models without our written consent.

10. Acceptable Use

You agree not to use the Site for anything unlawful; submit false information or someone else’s information; impersonate any person; interfere with the Site’s security or operation; or post content that is harassing, misleading or infringes anyone’s rights.

11. Your Submissions

If you send us reviews, comments or photos, or tag us on social media, you confirm you have the right to share that content and you give us a non-exclusive, royalty-free license to display it on the Site and our social channels, with credit where practical. We will never use your treatment photos without your separate written consent. Please do not send health information through general contact or newsletter forms.

12. Third-Party Services

The Site links to and relies on third-party services, such as our booking platform, payment processor, Instagram, TikTok and analytics providers. Their own terms and privacy policies apply, and we are not responsible for their content or practices.

13. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including that the Site will be uninterrupted, error-free or secure, or that its content is complete or current.

14. Limitation of Liability

To the fullest extent permitted by law, Rise Aesthetics is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site is limited to the greater of $100 or the amount you paid us through the Site in the 12 months before the claim. This section applies to your use of the Site and does not limit any liability that cannot be limited under Arizona law.

15. Indemnification

You agree to defend and indemnify Rise Aesthetics and its owners, providers and staff against claims, losses and reasonable legal fees arising from your misuse of the Site, your submissions or your violation of these Terms.

16. Privacy and Health Information

Our Privacy Policy explains how we handle information collected through the Site. Health information you share as part of your care is protected according to HIPAA privacy standards, as described in our Notice of Privacy Practices. If the two conflict on health information, the Notice of Privacy Practices controls.

17. Dispute Resolution and Arbitration

This section covers disputes about the Site, these Terms, our SMS program and our other communications. Disputes about your medical treatment are governed by your patient intake and consent documents.

Informal resolution first. Before filing a claim, you agree to email us at booking@riseaesthetics.co with a description of the issue and give us 30 days to try to resolve it.
Binding arbitration. If we cannot resolve it, the dispute will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Maricopa County, Arizona, or by video. Either party may bring an individual claim in small claims court instead.
Class action and jury waiver. You and Rise Aesthetics each waive the right to a jury trial and to participate in a class or representative action.
Time limit. Any claim must be filed within one year after it arises, where permitted by law.

18. Governing Law

These Terms are governed by the laws of the State of Arizona. Any matter not subject to arbitration will be heard in the state or federal courts located in Maricopa County, Arizona.

19. General

We are not responsible for delays caused by events beyond our control. We may suspend or end your access to the Site at any time for violation of these Terms. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy and SMS Terms & Conditions, are the entire agreement about your use of the Site. Clicking, submitting a form or booking online counts as your electronic signature.
